1. Introduction
Welcome to MyLegacySpace.ai ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our genealogy and social media platform, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
Legally Binding Agreement: These Terms constitute a legally binding agreement between you and MyLegacySpace.ai.
2. Eligibility
You must be at least 13 years old to use our Service. However, if the laws of your state or country require you to be older than 13 to use our Service or to provide your personal data without parental consent (e.g., 14, 16, or 18 in certain jurisdictions), then that higher age shall apply as the minimum age for you.
By using the Service, you represent and warrant that you meet this age requirement. If you are a minor (under 18), you represent that you have the permission of a parent or guardian to use the Service. If you are using the Service on behalf of a minor (e.g., as a parent adding a child to a tree), you represent that you have the legal authority to do so.
3. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
4. User-Generated Content and Conduct
4.1 Content Ownership & Licenses
You retain ownership of the content you create, upload, or post to the Service ("User Content"). However, by posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
4.2 Copyright of Historical Assets
You acknowledge that "old" does not always mean "public domain." You agree strictly NOT to upload content (e.g., professional photos, museum archives) unless you own the rights or have permission. You bear full liability for any copyright infringement claims arising from your uploads.
4.3 Prohibited Content
You agree NOT to post any content that:
* Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
* Infringes upon the intellectual property rights or privacy rights of others.
* Contains nudity, sexual acts, or excessive violence.
* Promotes discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or age.
* Constitutes spam, unauthorized advertising, or solicitation.
* Contains software viruses or any other malicious code.
* Involves the "doxing" of other users or private individuals without their consent.
4.4 Social Media Interactions
Our Service allows you to interact with other users (e.g., comments, messages, sharing). You agree to interact respectfully. We reserve the right to remove any content or suspend any user that violates our community standards or these Terms.
5. Genealogy Specific Terms
5.1 Accuracy of Information
You agree to provide accurate information to the best of your knowledge when building family trees. Deliberately falsifying genealogical records is prohibited.
5.2 Living Relatives
You may create records for living relatives. However, you must respect their privacy. You warrant that you have obtained the necessary consent from any living individual before posting their personal details (e.g., email, phone number, current address) or photos.
5.3 Deceased Persons
While data protection laws (like GDPR) typically apply to living individuals, we are committed to respecting the memory of deceased persons. You agree not to post information about deceased persons that is defamatory, disrespectful, or that would cause unnecessary distress to living relatives.
5.4 Family Disputes & Neutrality
Genealogy can sometimes lead to disagreements about lineage or facts.
* Neutral Platform: We are a platform for user-generated content, not an arbiter of genealogical truth. We do not adjudicate family disputes.
* Conflicting Data: Different users may have different trees with conflicting info. We generally do not remove one user's data at the request of another unless it violates our Terms (e.g., harassment, privacy of living info).
* Right to Unlink: If you are a living person and object to being included in another user's tree, you may request to be "unlinked" or have your personal data hidden. We prioritize the privacy of living individuals over the completeness of a tree.
5.5 AI Features & "Hallucinations"
Our Service may use AI to suggest ancestors, colorize photos, or write bios. You acknowledge that AI can make mistakes ("hallucinations"). You are responsible for verifying any AI-generated information before accepting it as fact. We disclaim all liability for errors introduced by AI tools.
5.6 DNA Data (If Applicable)
If you upload DNA data:
* You represent that the DNA sample is yours or that you have obtained explicit legal authorization to share it.
* You understand that DNA data is sensitive and usually immutable.
* You grant us permission to process this data to provide ethnicity estimates, matches, and other Service features.
* We will NOT sell, lease, or rent your individual-level DNA data to third parties (including insurers, employers, or law enforcement) without your explicit separate consent, unless compelled by a valid legal order.
5.7 Third-Party Genealogy Data
Our Service integrates with third-party genealogy databases, including FamilySearch, to provide record matching features.
* Personal, Non-Commercial Use Only: Data obtained from FamilySearch and other third-party sources through our Service may NOT be resold, redistributed, sublicensed, or made commercially available by you.
* No Scraping or Bulk Download: You agree not to systematically download, scrape, or bulk-extract data from third-party sources via our Service.
* Third-Party Terms: FamilySearch data is additionally governed by [FamilySearch's Terms of Use](https://www.familysearch.org/terms). In the event of a conflict between these Terms and a third-party provider's terms, the more restrictive terms shall apply.
* Data Accuracy: We do not warrant the accuracy or completeness of data obtained from third-party sources. You are responsible for verifying any information before relying on it.
5.8 AI-Powered Features & Third-Party Processing
Our Service uses artificial intelligence and machine learning features powered by third-party providers. By using these features, you acknowledge and agree:
* AI Photo Restoration: Photos you submit for restoration or colorization are transmitted to Replicate, a third-party AI service, for processing. Restored images are returned to and stored within your account.
* AI Support Chat & Research Agent: Conversations with our AI support bot and AI research queries are processed by Microsoft Azure OpenAI (GPT-4o). Your conversation content, including names and family details you provide, is transmitted to Microsoft Azure for processing.
* Voice Integration: If you use voice chat, your audio is transmitted in real time to Microsoft Azure for speech recognition and response generation. Transcripts of voice sessions are stored within the Service.
* No Accuracy Guarantee: All AI-powered features are provided "as-is." AI can produce errors, inaccuracies, or fabricated information ("hallucinations"). You are solely responsible for verifying any AI-generated content before relying on it.
* Usage Limits: AI feature usage is subject to limits based on your subscription tier (Free, Family, or Legacy Pro). Exceeding these limits may result in temporary unavailability of AI features until the next billing cycle.
5.9 Subscription & Billing
* Auto-Renewal: Paid subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date.
* Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.
* No Refunds: We do not offer refunds for partial billing periods. If you cancel mid-cycle, your subscription benefits continue until the end of the period you have already paid for.
* Grace Period: If a payment fails, we provide a 7-day grace period during which you retain access to paid features. If payment is not resolved within the grace period, your account will be downgraded to the Free tier.
* Donations: Donations made through the Service are one-time, voluntary payments. Donations are non-refundable and are not tax-deductible unless explicitly stated otherwise.
5.10 GEDCOM Data Import, Export & Sharing
* User Responsibility: You are solely responsible for the accuracy of data you import via GEDCOM files and for ensuring you have the right to share that data.
* Shared Links: GEDCOM export links you generate may expose family data to anyone who possesses the link. You are responsible for sharing links only with intended recipients.
* Privacy Modes: Export privacy options (include all, redact living, exclude living) are available. It is your responsibility to select the appropriate privacy level for your export.
* No Competing Use: Data exported from the Service may not be used to create a competing service or to systematically replicate the Service's database.
5.11 QR Memorial Plaques
* Physical Goods: QR Memorial Plaques are physical goods shipped to your provided address. Delivery timelines are estimates only and are not guaranteed.
* Personalized Items: Due to the personalized nature of QR plaques, returns and exchanges are not accepted unless the item arrives damaged or defective.
* Shipping Liability: We are not liable for shipping delays, loss, or damage in transit caused by third-party carriers.
* Digital Link: QR codes on plaques link to digital memorial profiles hosted on the Service, which are governed by these Terms. If the associated account is deleted or the memorial profile is removed, the QR code will no longer resolve to a valid page.
5.12 Custom Memorial URLs
* Availability: Custom memorial URLs are subject to availability on a first-come, first-served basis.
* Prohibited URLs: We reserve the right to reclaim or reject any custom URL that violates these Terms, contains offensive content, or infringes on trademarks.
* No Guarantee After Deletion: URL availability is not guaranteed after account deletion. Released URLs may become available to other users.
5.13 Storage Limits
* Tier-Based Quotas: Storage quotas vary by subscription tier. Current limits are displayed on our pricing page and in your account settings.
* Exceeding Limits: You will be notified when approaching your storage limit. Uploads will be blocked when your quota is exceeded until you upgrade your plan or free up space.
* Account Changes: Upon account deletion or downgrade to a lower tier, excess data beyond the new tier's storage limit may be subject to removal after 30 days' notice.
6. Intellectual Property Rights
The design, code, graphics, and interactive features of the Service are the property of MyLegacySpace.ai and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service without our prior written consent.
7. Privacy
Your use of the Service is also governed by our [Privacy Policy](./privacy_policy.md), which explains how we collect, use, and share your information.
8. Limitation of Liability
To the fullest extent permitted by law, MyLegacySpace.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any User Content or conduct of any third party on the Service.
9. Termination
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law principles.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
