DMCA Policy — Copyright Takedown Procedures

MyLegacySpace.ai respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512.

Filing a Takedown Notice

If you believe that content on our Service infringes your copyright, please submit a written notification to our designated DMCA agent containing the following:

  • Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).

  • Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., a URL or description of where the content appears on our Service).

  • Your contact information, including your name, address, telephone number, and email address.

  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

  • Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).

    Our Response

    Upon receiving a valid DMCA takedown notice, we will:
    * Acknowledge receipt within 48 hours.
    * Investigate the claim and, if valid, remove or disable access to the infringing material within 72 hours of receiving a valid notice.
    * Notify the user who posted the allegedly infringing content that the material has been removed.

    Counter-Notice Procedure

    If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notice containing:

  • Identification of the material that was removed and the location where it appeared before removal.

  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.

  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district in which MyLegacySpace.ai may be found), and that you will accept service of process from the person who filed the original DMCA notice.

  • Your physical or electronic signature.
  • Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the removed material within 10-14 business days, unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity.

    Repeat Infringer Policy

    We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. If a user receives multiple valid DMCA takedown notices, their account may be suspended or permanently terminated.

    Good Faith

    Please note that submitting a false or misleading DMCA takedown notice may result in liability under Section 512(f) of the DMCA, including damages, costs, and attorneys' fees. If you are unsure whether the material infringes your copyright, consider seeking legal advice before filing a notice.
